All services provided by BizFileIt™ (BFI) may only be used for lawful purposes. We reserve the right to refuse service to anyone. Customers agree to and indemnify and hold harmless BFI from any claims resulting from the use of our services.

Use of our services to store, send and infringe upon any copyright, trademark or for any unlawful purpose is prohibited. Examples of unacceptable material which we will not accept to be filed through our service include: pirated software, illegal material, material relating to illegal activities, stolen material, threatening & hate material, malicious material:  filing, storing or sending items of this nature are prohibited.

Potential harm to minors by the use of our service is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography.

BFI reserves the right to terminate your service, require removal of things filed and stored, restrict access to you or disable as necessary any service access if filed material or other components do not comply with its Terms of Service or established policies, at its sole discretion, with or without notice.

Ownership of things filed 

Ownership to and rights over what you file belong to you. BFI assume no rights or ownership whatsoever to anything you file, send and store. 

Storage Space Allocation 

When you subscribe to the BFI service, you are allocated a set space allowance consisting of a combination of bandwidth and disc space allowance (space) on our server systems. This allowance varies depending on what level of service you purchase. To pass or increase the allocated amount, you must purchase additional space or upgrade your level of service. Unused space for any service period cannot be transferred or carried over to subsequent service periods.

Price Change  

The amount you pay for any service period and level of service will not increase from the date of purchase. We reserve the right to change prices listed on bizfileit.com and the right to increase the amount of resources given to services at any time.

Refunds  

All monies paid for the services that BFI provide is non refundable. If you cancel your service, or your service is suspended or cancelled due to you breaching our Terms of Service, no refunds will be available.

INDEMNIFICATION  

YOU AGREE THAT YOU SHALL DEFEND, INDEMNIFY, SAVE AND HOLD BFI HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE LAWYER'S FEES ASSERTED AGAINST BFI, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD TO YOU OR USED BY YOU, YOUR AGENTS, EMPLOYEES OR ASSIGNS. YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS BFI AGAINST LIABILITIES ARISING OUT OF; (1) YOUR USE OF ANY PRODUCT OR SERVICE PROVIDED TO YOU (2) ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS OR SERVICES SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH BFI; (3) ANY MATERIAL STORED OR SUPPLIED BY CUSTOMER INFRINGING OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY; (4) COPYRIGHT INFRINGEMENT; (5) VIOLATION OF THE RIGHTS OF ANY OTHER PERSON OR ENTITY AND (6) ANY ILLEGAL MATERIAL STORED AND OR DELIVERED TO ANYONE OR ANYTHING FROM BFI SERVER/S.

GENERAL DISCLAIMER  

BFI SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES SUFFERED BY ANYONE. BFI MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES OR PRODUCTS WE PROVIDE. BFI SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". BFI DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF PROPRIETORY RIGHTS. THIS INCLUDES LOSS OF DATA RESULTING FROM SERVER DISRUPTIONS, DELAYS, NO SERVICE ACCESS, WRONG DELIVERY AND ANY AND ALL SERVICE INTERRUPTIONS AND NON PERFORMANCE CAUSED BY BFI AND ITS EMPLOYEES. BFI DO NOT WARRANT THAT THE SERVICE WILL BE ERROR FREE, UNINTERRUPTED OR AVAILABLE. BFI'S LIABILITY FOR ANY CLAIM RELATED TO YOUR PURCHASE OF OUR SERVICES OR PRODUCTS WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY WILL NOT EXCEED USD$10.00 OR THE PURCHASE PRICE YOU PAID FOR YOUR SERVICE, WHICHEVER IS GREATER.

Arbitration  

By using BFI services, you agree to submit to binding arbitration. If any disputes or claims arise against BFI or its subsidiaries, such disputes will be handled by an arbitrator of BFI choice. Arbitrators shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator's award is final and binding on all parties. The Federal Arbitration Act, and not any state arbitration law, governs all arbitration under this Arbitration Clause. You are also responsible for any and all costs related to such arbitration.

Legal Jurisdiction

The laws of the State of Queensland , Australia apply.

BFI reserves the right to revise its policies including these Terms of Use at any time without notice.
